It has always been difficult for me to take vacations, even when I worked in the context of a partnership. As an independent practitioner, taking vacations is doubly difficult.
As with all else, I believe that you need to set expectations of both adversaries and clients when you are on vacation. A well phrased voice mail which stresses that you are unavailable except for legitimate emergencies seems to do the trick. The first two days, I had a very large number of calls. By the fifth day, the number of calls had gone down tremendously. There is never a shortage of work for attorneys when it comes to their client’s problems. I truly believe however that it is critical for a lawyer to maintain balance in their lives if they have any hope of providing value to their clients by way of good competent legal advice.
